This was a three story complex the roofing contractor was hired to put us up on the roof to scope for damage... I saw this guy painting and said, "MAJOR OSHA Violation, not to mention dangerous." The painting foreman looked and at me as if I was crazy and shrugged his shoulders...
Painters have an exemption from the laws of gravity. Surely you knew?
I would not let an employee do that. Personally I have done a lot worse.
There seems to be quite a few paint patches around the edges of the balcony, like maybe they just had EIFS?stucco repair. If any moisture had gotten in at the end of those rails, they could be screwed into rotted wood, ready to give out.
That's just retarded. There's a ladder already extended thats lying against the wall to the right. Use the dam thing.

Well, he would still be better off to lean it against the railing and tie it off to the railing than what he's doing. Assuming the railing is secure of course.
Must be a drag to go back and dip his brush in the paint, likely on the tailgate...
