Jet Why would you feel that way ? I understand it is your Opinion . I think I'm representing the contract. Bringing a resolution , I haven't started this project yet. That being said it will be on ethical , moral terms or not at all . If that bugs ya then you might want to take a second look at your own character. Nothing personal JMO ;)>>>

The only True and Integrity driven arbitrator would be one who has no stake in the claim and no alliances.

If this arbitration position is created by your employer, how far can the left hand be from the right hand?

You may have personal ideologies of your own integrity, but to be paid by one party and presumed to also be dealing fairly with a non-continuing paid party implies great favoritism on behalf of the party, your Employer, who has the opportunity to either increase, decrease or eliminate your arbitration case load.

I see no Clean Hands in this deal, even if you go into it with that though and feeling sincerely. There is too much at stake and too much inferred pressure to arbitrate in favor of the hand that is feeding you.

How could one in such a position subconsciously even, not be influenced to a great degree?

I do honestly believe that your intent is clean and admirable, but I find the companies motives to have their own paid arbitor handle such cases with a presumed fair and neutral perspective.

Even from your own writings of admirable defense of your companies and other like minded insurance conglomerates tactics, I feel that your perspective has already been altered and tainted. You see the company requiem and supposed balanced fair play, while the trained and tutored staff is going against an army of individuals rather than a unified presence.

On the other hand, who would be the next likely candidate for this type of position? If that were the only choice, then you would have my full support and backing, but alas, I feel that the only true impartiality could be obtained from a party not financially involved with the masters in charge and they will not let that occur.

In many court districts, they allow a Mandatory Arbitration prior to proceeding to actual trial before a judge.

This, in my very humble opinion, would be the only conscionable alternative.

The arbitration policies required are a method to circumvent the alleged victimized party from having their day in court, which would set undeniable precedent for others to follow.

Why would the insurance giants be intimidated by that truer impartiality and lasting record? If you can get them to answer that, without choking on there words, you will see that they will have no part in an open, just and fair trial to play out.

Even a proclaimed independent arbitration association would be hard pressed to remain financially unbiased, due to the fee potential to be generated.

Ed I hear ya. On the other hand there happens to be more than one party involved in the process. To take what I assume your position of a insidious insurance company with anti-social psychopathic predatorial general positions of power. Polarizing ,cospiratoral . " i dunno " can't see it . I know the people inside . I won't go on till I get some clarification on that position first. Have I come close ? I'm asking for clarity not to incite .>>>

I wasn't questing your personal integrity.

I can only guess that it most likely would be of a very high standard, unless I knew you personally and in greater depth.

There just does not, at first glance of this picture, seem to be an arms length distance between the affected party potentially obligated to proffer additional funds to one of their contractually insured customers.

If an unbiased and truer expectation would be desired, a revolving arbitration method through the local courts would seem to make sense, but it seems as if the Insurance Companies and ANY entity, such as mass production home builders seem to prefer the cacophony effect that an arbitrated decision tenders, so that precedents remain opaque to future interested parties.

The court systems in my jurisdiction and the entire state utilize retired judges and attorneys who have the knowledge and historical credentials to arbitrate freely without preferential bias, which initially allows for the case to bypass the judicial court system, yet still allows that option as an end result if the arbitration decision was not in line with either parties thinking.

Arbitration results being held secretive, by their very nature seem to intentionally hide the extenuating and ongoing possibilities of internal corruption.

That is not to say that this is true in a majority of cases, but just by having that potential cloud the only refuge available to the customer would seem to hide an underlying motive. With all of the Billions of dollars that are at stake, the argument that arbitration is speedier and less costly becomes mute.

On the initial presentation of this option being designated as a fair and reasonable method to resolve differences, especially with the Insurance Company picking up the tab, it may seem that this action is being done out of the Goodness Of The Heart in favor of good customer relations.

Then BOOM, when the decision is completely skewed and the victimized party is without additional recourse, then they will realize the total unbiased favoritism of the entire procedure.

Taken from the new thread started on another forum. It appeared to me Ed was doing an edited version of what was happening on this forum. I haven't heard back from him yet but felt it only fair to re post my response to him here Hey guys I finally am able to log onto the RCS. I'll continue it here . Ed I fly to Baton Rouge Thur and head up to Chicago from there I have not been told my destination yet. I can only speculate Barring ton area. I'll let you know as I get closer to leaving. I fly back to the Tampa Bay area sometime early next week if nothing happens. One way a program works now, It may be more agreeable to some here.......when there is a disagreement between the parties an independent , ? ( alacrity contractor ) is brought in . For those who don't know , Alacrity contractor is one who is on a list with the insurance companies insured licensed etc. The Alacrity contractor will re scope the loss and come up with a number and present it . It becomes the mark. If the parties involved don't like it one way or another it is that number that is used. This program I'm talking about is new and in the initial stag of development. I would love to be involved for a few reasons. First I like knowing I'll be resolving conflict , I know I am the right person for reasons stated before. I'll be paid for doing something I am well qualified for .There also is a sense of righting a wrong that has a strong influence on me. One of the many reasons I love this job. Perhaps arbitrating wasn't the right verbiage ?? My lack of understanding the English language is at fault here. I know I can't save the world . What little I can do I'll take it Ed was there a reason you only posted threads you created and not the others from the RCS ?Pulling perhaps statements out of other threads to make a point and perhaps redefine my points for what reasons ??. I'm sorry Ed it appears from here to be disingenuous and borders precariously on the edge of the abyss to the deep dark selfish gaping hole of sophism>>>

I guess I "feel" that way because I worked for Liberty Mutual back in the 70's. Went through an extensive eight week "training" course on how to screw people out of their settlement funds. After being in the construction business for over 34 years and dealing with insurance carriers on a number of claims, I know, and I certainly think YOU know, the game. You asked for opinions........you got them, with dividends.

I did not Edit Any of the posts that I copy/pasted and even mentioned to you in that thread that I would copy the rest of them if you felt they made a point. All posts were copied in their entirety, with the exception of the Brad Pitt and Jennifer Lopez comments. It seemed to me that those comments had noting to do with the topic, so I completely ignored them.

I did that task as a favor to you, since you stated you could not log on here and I was using my home computer, which is much slower and cumbersome to do those tasks than my office computer.

The ones that I intentionally did not copy were more personal remarks to the previous posters, which did not seem to add to the total discussion, but I DID inform you that if you still were not able to log in here, I would be happy to copy/paste the rest of them in their entirety if you requested.

I did not selectively choose those that made one point over the other and my offer to retrieve the rest of the posts for you should have made that point implicitly clear.

Back To Ed's Reply: I don't have my dictionary available for the word, "sophism", but will look it up later.

Could you point out where I changed any of your words even in one slight iota?

If anything at all, I leaned over more in your direction by commending you on your self conscious conclusion that you would be the better choice as an arbitrator, given the alternative options that may have been available.

You seem to find negativity in my posts as if it were directed towards you personally, where that is far from the truth.

My disagreement is the lack of an Arm's Length Distance between the two vested parties in the disagreement and who is paying or previously paid the person designated to make a conclusive decision to the facts of the situation.

By the way, I live only about 10 minutes away from Barrington, but there are several other towns with the name Barrington in them, but they all are close, so I hope that you take me up on my offer to get together when you are in town.

Yeah Ed I am taking it a little more cautiously than I might in another situation. In this particular venue there is an underlying hostility to this subject. For clarity sack I approach it like this. I am more than appreciative of your understanding my personal view point. It is extremely likely some in here will judge me from a single or very few comments. Sorry I just went back and read all of the threads posted. I'm sometimes lazy For those who care abut such things this is the modern definition. It has meant quite the opposite in ancient times. A sophism is taken as a specious argument used for deceiving someone. It might be crafted to seem logical while actually being wrong, or it might use difficult words and complicated sentences to intimidate the audience into agreeing, or it might appeal to the audience's prejudices and emotions rather than logic, i.e. raising doubts towards the one asserting, rather than his assertion. The goal of a sophism is often to make the audience believe the writer or speaker to be smarter than he or she actually is, e.g., accusing another of sophistry for using persuasion techniques. An argument Ad Hominem is an example of Sophistry.

A sophist is a user of sophism's, i.e., an insincere person trying to confuse or deceive people. A sophist tries to persuade the audience while paying little attention to whether his argument is logical and factual.

Jet That analysis could be used in any of the trades , banks , etc. It is the individual who make the difference.>>>

Jet The company " creed " also contains a code of " Ethics " If you took this course in the insurance industry today there is a heavy emphasis on Ethics. The Hippocratic oath I shall do no Harm is a basic tenant. Now maybe your employer was a bad person I don't know. I know ethics rule where and how I work.>>>

Thanks guys It has been determined that this program though appealing won't work after several conversations . For the obvious reasons laid out by some posters . To do evil intent, quite the contrary . There was no way to separate the powers that be no matter how ethical or moral. Ethics and morality rule in this business. I only wish it was as prevalent in the roofing trades, as it is in the insurance business . That may have something to with regulation and lawyers looking for the bucks also. The little guys in roofing are not as lucrative targets.i dunno JMO>>>

The intersection you mentioned, just happens to have one of the best Burger Restaurants in the Chicago Area, so if you like a good meal, and can get away from the Mission Control Magic Bus, I'll meet with you and treat you to lunch or dinner about one block away at The Assembly Restaurant.

I love good burgers etc I'm for sure going that direction the end of this week. My itinerary still stands until the goods are delivered. If your speaking of the higgins road location It will be middle morning Sat. If were speaking about Fri. I sent you a location. I have an email to the boss ( Vickie } looking for feet on the ground confirmation about the other stuff and will hopefully be apprised of that situating. I would have to ask my wife how to send a text. I know her duplicate phone does it all the time, but I never got into that type of messaging.
